Terms and Conditions

Please read all these terms and conditions.

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. 1. Application

1.1 These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you) We are RPT Electrical Supplies Ltd a company registered in England and Wales under number 13337703 whose registered office is at Unit 21 Moor Park Industrial Estate, Tolpits Lane, Watford, WD18 9SP with email address info@rptelectrical.co.uk; telephone number 01923616966 (the Supplier or us or we).

1.2 These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.

2. Copyright

2.1 All copyright, trademarks and all intellectual property rights on the Website and its content are owned by or licensed to Rptelectrical.online.co.uk or otherwise used by Rptelectrical.online.co.uk as permitted by law.

2.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. No content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

3. Liability

3.1 RPT Electrical Supplies Ltd will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, loss of business, interruption to business, for any loss of business opportunity, or for any indirect or consequential loss arising out of or in connection with any contract between you and Us.

3.2 Our maximum liability to you for all other losses arising out of or in connection with any contract between you and Us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be a sum equivalent to 100% of the total sums paid by you for the Goods under the contract in question.

3.3 The terms implied by Sections 13 to 15 of the Sale of Goods Act 1979 and by Sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.

3.4 Nothing in these Terms of Sale seeks to limit or exclude Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); for fraud or fraudulent misrepresentation; for breach of the terms implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; for defective products under the Consumer Protection Act 1987; or for any other matter in respect of which liability cannot be excluded or restricted by law.

4. Goods

4.1 The description of the Goods is as set out in our website, catalogues, brochures, or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in colour or size.

4.2 In the case of Goods made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.

5. Basis of Sale

5.1 A Contract will be formed for the Goods ordered, only upon the Supplier sending an email to the Customer saying that the Order has been accepted or if earlier, the Supplier’s delivery of the Goods to the Customer.

5.2 Any quotation is valid for a maximum period of 7 days from its date unless we expressly withdraw it at an earlier time.

5.3 We intend that these Terms and Conditions apply only to a Contract entered into by you as a Consumer where we, the Supplier and you the Customer, enter the Contract at any of the Supplier’s business premises, and where the Contract is not a contract (i) for which an offer was made by the Customer in the Supplier’s and the Customer’s simultaneous physical presence away from those premises, or (ii) made immediately after the Customer was personally and individually addressed in the Supplier’s and the Customer’s simultaneous physical presence away from those premises. If this is not the case, you must tell us, so that we can provide you with a different contract with terms which are more appropriate to you and which might, in some way, be better for you, eg by giving cancellation rights pursuant to consumer protection law. Business premises means immovable retail premises where we carry on business on a permanent basis or, in the case of movable retail premises, on a usual basis.

6. Prices

6.1 The price of the Goods and any additional delivery or other charges for the Goods, and the total price of them and the charges, is as agreed in writing or via our quotation process. RPT Electrical Supplies Limited reserves the right not to supply goods which are found to be incorrectly priced. In this event you may reconfirm the order upon price amendment or cancel the order and receive a full refund. Prices and charges include VAT at the rate applicable at the time of the Order.

7. Delivery

7.1 We do not generally deliver to addresses outside England and Wales, Scotland, Northern Ireland, the Isle of Man and Channels Islands. If, however, we accept an Order for delivery outside that area, you may need to pay import duties or other taxes, as we will not pay them.

7.2 You agree we may deliver the Goods in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.

7.3 If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.

7.4 The Goods will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them.

7.5 Risk of damage to, or loss of, the Goods will pass to you when the Goods are delivered to you.

7.6 You do not own the Goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the Goods still owned by you, in which case you must return them or allow us to collect them.

7.7 RPT Electrical Supplies Limited shall not be liable for any loss arising from items being out of stock. Claims for incomplete or damaged items must be made, in writing via email within 48 hours of delivery.

8. Returns

8.1 By law, customers have the right to withdraw from the purchase of an item within 14 days of the day after the date the item is delivered. This only applies to unopened items in their original, sealed packaging.

8.2 Customers must return unwanted goods at their own cost using a ‘signed for’ carrier service. We are unable to exchange items that are not damaged, defective, or incorrect after these 14 days, nor if they have been used or removed from their original packaging. Upon inspection the sale will be credited less the initial carriage charge.


8.3 Please note that returning some items may incur a handling charge depending upon the manufacturer’s terms. This may be as much as 40% of the original invoiced amount from some manufacturers. Please carefully check and confirm all specifications before ordering. No item can be returned without an authorised returns number.

9. Conformity

9.1 We have a legal duty to supply the Goods in conformity with the Contract and will not have conformed if it does not meet the following obligation.

9.2 Upon delivery, the Goods will: a) be of satisfactory quality b) be reasonably fit for any particular purpose for which you buy the Goods which, before the Contract is made, you made known to us (unless you do not actually rely, or it is unreasonable for you to rely, on our skill and judgment) and be fit for any purpose held out by us or set out in the Contract; and c) conform to their description.

9.3 It is not a failure to conform if the failure has its origin in your materials.

9.4 We will provide the following after-sales service: All goods supplied by us are manufactured by others. Therefore, we shall pass onto you the benefit of the warranty, if any, given by the manufacturer of the goods. All returns must be approved by us before a credit note is provided. 10. Withdrawal and cancellation

10.1 You can withdraw the Order by telling us before the Contract is made, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.

10.2 You can cancel the Contract except for any Goods which are made to your special requirements by telling us no later than 2 days after the Contract was made, if you simply wish to change your mind and without giving us a reason, and without liability, except in that case, you must return to any of our business premises the Goods in undamaged condition at your expense. Then we will without delay refund to you the price for those Goods, but we can retain any separate delivery charge. This, however, does not apply for non-stock items which are specially ordered. This does not affect your rights when the reason for the cancellation is any defective Goods.

11. Refusal of Service

11.1 RPT Electrical Supplies Limited reserves the right to refuse supply of any goods to any person or any company for any reason.

12. Termination

12.1 We may without prejudice to our other rights and remedies determine the contract or any unfulfilled part of it or withhold further deliveries or make partial deliveries if: a) you fail to make payment on the due date under this or any other contract between us; b) you purport to cancel or suspend, or commit any breach of, this or any other contract between us; c) you become insolvent or make any composition with your creditors or have an administrator or a receiver appointed over all or any part of your undertaking or assets or go into liquidation and we shall be entitled to recover from you all our loss including any loss of profit or loss on re-sale.

13. Governing Law

13.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England, and you hereby submit to the exclusive jurisdiction of the English courts.
